WEBSHOP GENERAL CONDITIONS
1. GENERAL
1.1 These Terms and Conditions apply to the purchase of products from www.oxygenemods.com. 
1.2 The conditions applicable to the products offered for sale on this website are listed below. By placing an order, you accept and agree to be subject to these conditions. 
1.3 The products on www.oxygenemods.com are sold by TITANIUM S.r.l., Via Roma 5/9, 31056 Roncade (TV), Italy, V.A.T. n. IT 00886770262.
1.4 Titanium S.r.l. reserves the right to change these terms at any time without notice. Such changes will not apply to orders that are placed before revised conditions are published.
1.5 It should be noted that Titanium S.r.l. is based in Italy and therefore is subject to Italian law. 
1.6 Products on www.oxygenemods.com are offered to “consumers” only. If you are interested in wholesaling Oxygène products, please contact info@oxygenemods.com to get more details and start a wholesale account.
1.7 We do not sell to Customers who are under 18 years old. By creating an account on our website and ordering products, you certify that you are at least 18 years old. We cannot guarantee that every user is above 18 years old and we are not responsible for the orders received by people under 18.
1.8 These terms and conditions are not applicable to eventual deals done with third parties who could appear on www.oxygenemods.com through links, banners or other means.

1.10 All products on www.oxygenemods.com are intended to be used by conscious adults only.
Titanium S.r.l. declines any responsibility for damages due to improper and incorrect use of said products as for example and not limited to: 
- connection with unsafe devices
- use of old or damaged or low quality batteries
- use of liquids containing toxic or addictive substances such as nicotine
- use of electric devices in presence of inflammable substances
- use of damaged or modified products
All products bought from www.oxygenemods.com must be kept away from childern and incapable people.
2. SUBMISSION OF ORDER
2.1 An order may be made online by completing the order form on the website. 
2.2 Before placing your order, you will be directed to the Terms and Conditions and to the Privacy Policy. By placing your order, you are accepting these terms and conditions.
2.3 Titanium S.r.l. reserves the right to accept not incomplete or incorrect orders. All products are supplied subject to availability. We will contact you as soon as possible by e-mail if the ordered product is not available. 
2.4 We aim at maintaining a good quality of the images published on the site, but please be aware that the product ordered may vary in color/design from the one showed on the website.
2.5 If you provide a valid e-mail address, we will notify you as soon as possible to confirm your order. 
3. DELIVERY
3.1 Titanium S.r.l. will perform the delivery as soon as possible after payment is received.
3.2 If a product is not available in the quantity ordered, we will notify you accordingly and you can then decide if you want to order a lesser amount or cancel the order.
3.3 Titanium S.r.l. may at its discretion decide to make partial shipments. If this happens, you will incur in no extra cost. It will only be charged as if everything was shipped together.
3.4 If delivery is not possible within 15 days, you are entitled to cancel the order. If a payment is made, such payment will be refunded by us as soon as possible but within a maximum of 14 days.
3.5 Incomplete, incorrect or unpaid orders, as well as those orders coming from Users who are suspected to be fraudulent, will not be finalized and will be canceled.  
4. PRICES AND DELIVERY COSTS
4.1 All prices are quoted in Euros. The prices published on the website exclude delivery costs. Since prices can be updated, make sure you check your total amount before finalizing the order.
4.2 Delivery charges may vary from time to time depending on your selected shipping method, and those costs are calculated separately and shown on the website when you place your order. The total price listed on the order form is the total amount of the ordered products. Should the shipping costs exceed the calculated for any reason, Titanium S.r.l. is entitled to have these costs reimbursed.
4.3 You agree to indemnify Titanium S.r.l. for any additional shipping and/or handling charges incurred as a result of your failure to receive or collect the delivery or an incorrect/incomplete address at which it has not been possible for the selected carrier to deliver in accordance with the agreed delivery terms. 
5. PAYMENT
5.1 You can pay for products using the payment methods shown on the website. 
5.2 Titanium S.r.l. provides a secure payment line using an external supplier and ensuring that you always have the highest level of security, encrypting your payment information automatically as you enter it.
6. RIGHT OF WITHDRAWAL, WARRANTY, DAMAGED AND/OR INCOMPLETE PRODUCTS
Returns
6.1 You may return items within a 14 day period.
Period runs from the day you received the goods or the first delivery is received.
Before the end of the withdrawal period, you must express your will to Titanium S.r.l. by writing to sales@oxygenemods.com and deliver the returning goods to the post office - or to another company that is in charge to forward them to us - within the deadline.
Unless otherwise agreed, you must pay the costs (postage/freight) for product return. 
6.2  You will loose your right to cancel the agreement if you are not able to return the product in the same conditions as when you received it and in its original packaging. We recommend at all times that you take appropriate and reasonable care to maintain the product's condition and that you ensure the product is returned undamaged.
6.3 If your product is faulty and is deemed so by the manufacturer, we will ensure you will be refunded within 30 days. We will refund only the amount received, not your delivery costs for returning the product.
6.4 Complaints regarding failure of the product must be sent within a reasonable time after you have discovered the defect. We recommend that you send your complaint by writing to Titanium S.r.l. at the email address sales@oxygenemods.com.
6.5 If the complaint is justified, you can ask for (a) a remedy for the defect, or (b) the supply of a replacement. 
6.6 If we are unable to remedy the defect in the product or to deliver a replacement or if such replacement is not successful, you will be entitled to a refund on the product.
7.  USE
7.1 Titanium S.r.l. assumes no responsibility for claims made as a result of (a) non-intended use or handling of the product, (b) used in combination with accessories for which the product is not intended. 
The buyer is made aware that even small errors in the handling of the products can damage them or permanently reduce their functionality, in which case the seller is not responsible.
Please bare in mind that improper use of the product could cause harm.
7.2 Buyer is made aware that the electrical components including batteries acquired at www.oxygenemods.com can overheat when connected to power and therefore cause excessive heat and fire. Therefore they must not be left unattended at power or placed near flammable effects. The buyer is responsible for any damages which may arise in this regard.
8. PRIVACY POLICY

9. FORCE MAJEURE
Titanium S.r.l. is not responsible for any failure or delay in the performance of the contract if and to the extent that such failure or delay is directly or indirectly caused by circumstances which are beyond Titanium S.r.l.’s reasonable control and could not have been avoided by taking reasonable precautions.
10. APPLIED LAW
10.1 This Terms and Conditions and the Privacy Policy are ruled by Italian law, in particular by Decree 6 September 2005 n. 206 and Decree 9 April 2003 n. 70.
